The Payroll/Personnel System was updated on the evening of September 16, 2010 with the range adjustments for the Postdoc employee title code.  Please start using the range adjusted rates for new hires and rehires. Dear CFAO and Academic Personnel Managers:

 

Following-up on the announcement of the postdoctoral scholar inaugural contract from a few weeks ago, this is to let you know that UCOP is working with appropriate offices at each campus to implement the across the board (ATB) salary increase due the postdocs for September 2010 (in the 10/1/10 paycheck).  Based on discussions thus far, UCOP will be providing campus with a customized program to implement these ATB salary increases for the applicable title codes, tentatively scheduled for the end of next week.   It has come to our attention that some of the academic departments may have already made the entries for these required salary increases in PPS, which will cause major problems because it will result in duplicative salary increase actions for postdocs (i.e., doubled the required salary increases agreed to by the postdoc contract).  Therefore, I am seeking your assistance in distributing this email to those in your org unit/departments responsible for postdoc employment matters and request them to do the following:

 

1.       Suspend all salary actions/entries in PPS regarding Postdoctoral Scholar (TCs 3252, 3253, 3254) until September 18, 2010.   This would allow all the offices involved in implementing the postdoc ATB salary increases sufficient time to run the special payroll program, verify the required salary increases, and to contact/follow up with any specific departments regarding any additional actions that are required to implement the required salary increases for postdocs.  

2.       Consult the Labor Relations office (Marianne Beckett, x2-2847; marianne.beckett at ucr.edu) and/or Graduate Division (Linda Scott, x2-3387, linda.scott1 at ucr.edu) before any salary increases are being implemented to ensure compliance with the new postdoc labor contract.

We apologize for any inconveniences this may and will cause in the affected departments, but would appreciate your assistance in this matter to inform the departments in your org unit regarding this very important process so that the postdoc salary increases can be accurately administered with the minimum amount of unnecessary disruptions, errors, and duplicative efforts.

 

We will work with the Payroll Office to provide the same information to the PPS Users group in the next week's group meeting and also via its listserv early next week.  Thank you.

Re:      UC Postdoctoral Scholars Ratified Collective Bargaining Agreement Between the PRO/UAW and the University of California

On August 12, 2010, Postdoctoral Scholars in the University of California system voted to ratify their first collective bargaining agreement.  Tentative agreement on the contract was reached on July 31 after 18 months of bargaining.  At UCR we recognize the vital role of Postdoctoral Scholars in the advancement of science as well as their very significant contributions to this university's stature in the research community.  We take pride in the fact that this university has striven for some years to support and enhance the working conditions of these scholars, beginning with the implementation of APM 390 in July, 2003.  With the signing of this agreement, APM 390 is no longer operative; and we are now required to implement the provisions for postdoctoral scholar appointments.  To that end, we want to highlight some of its key elements:

 

·         COVERED TITLES:  Postdoctoral Scholar-Employee (3252), Postdoctoral Scholar-Fellow (3253), Postdoctoral Scholar-Pay Direct (3254).

  

·         DURATION:  The agreement is a five-year contract, with no mid-contract bargaining, and will expire on September 30, 2015.

 

·         ACADEMIC JUDGMENT:  Faculty retains the ability to determine academic matters such as postdoctoral scholar performance, research quality, goals, and standards.

 

·         Compensation*:  

 

o   All postdoctoral scholars (Employees, Fellows, and Pay-Directs) will receive an increase in compensation or stipend effective beginning in the pay period of September 2010:  

§  Current Postdoctoral Scholars with salary less than or equal to $47,000 will receive a 3%  salary increase.

§  Current Postdoctoral Scholars with salary greater than $47,000 will receive a 1.5% salary increase.

 

o   Effective September 1, 2010, all newly appointed postdoctoral scholars must be appointed with a salary of at least $37,740 the new minimum.

  

o   Effective June 1, 2011, all newly appointed postdoctoral scholars must be appointed at the salary level commensurate with the postdoctoral scholars' experience level based on the National Institute of Health for its National Research Service Awards (NIH-NRSA) salary scale.

 

o   The experience-based pay scale used by the National Institute of Health for its National Research Service Awards (NIH-NRSA) for reappointment of postdoctoral scholars appointed on or prior to August 11, 2010 will be phased in between June 2011 and 2014, with salary increases capped at a maximum of 3%.

  

o   Effective June 1, 2014, all postdoctoral scholars will be placed on the NIH-NRSA salary rates based on their experience.

 

·         Appointments:  Postdoctoral scholar appointments will typically be in one-year increments, with management retaining the sole discretion to reappoint or not reappoint.

 

·         LAYOFF:  Layoffs of postdoctoral scholars may be implemented when appropriate funding becomes unavailable.  UC retains the sole discretion to determine when layoffs shall occur.

 

·         MENTORING AND Evaluations:  Mentoring is protected as an academic matter.  Supervisors retain the rights to assess and manage postdoctoral scholars' progress and accomplishment in research and professional development.  Supervisors are required to provide postdoctoral scholar at least one written performance assessment in a 12-month period.

 

·         TIME AND EFFORT COMMITMENT:  Postdoctoral Scholars remain FLSA exempt with a normal full-time workweek of at least 40 hours, with the emphasis placed on meeting the responsibilities assigned to the position. 

 

·         PERSONAL TIME OFF:  Twenty-four (24) days of paid time off must be used during the one-year appointment period.  These do not carryover upon reappointment or require payout when the postdoctoral scholar's one-year appointment ends.

·         BENEFITS:  A Health Plan exclusive to postdoctoral scholars is being maintained.  Postdoctoral scholars will begin paying for a portion of HMO coverage over the course of the Agreement; PPO contributions increase with cost.

 

A training program will be instituted shortly to provide guidance to administrators and Principal Investigators on this Agreement that governs terms and conditions of employment for postdoctoral scholars.  The Labor Relations Office will announce those opportunities as soon as UCOP's training plans are established.

 

*Details regarding the implementation of the salary increases for the September 2010 pay period will be coordinated by the appropriate offices.  Instructions related to salary implementation will be forthcoming under a separate email communication.
