UPDATE: TEMPORARY RESTRAINING ORDER GRANTED RE: NIH NOTICE NOT-OD-25-068


On Friday, February 7, 2025, the National Institutes of Health (NH) issued NOT-OD-25-068: Supplemental Guidance to the 2024 NIH Grants Policy Statement: Indirect Cost Rates<https://grants.nih.gov/grants/guide/notice-files/NOT-OD-25-068.html>.  As a result, UCR provided the campus with NIH proposal submission guidance yesterday.  Thereafter, the court granted two separate temporary restraining orders (see Civil Action No. 25-CV-10338-AK<https://storage.courtlistener.com/recap/gov.uscourts.mad.280590/gov.uscourts.mad.280590.25.0.pdf>  and Civil Action No. 25-CV-10340-AK<https://e.ropesgray.com/collect/click.aspx?u=V0FQNGhvMGtjbnlkOXVLM01LK2ZUT3o3d2RZZytQTk5WWlY5VjlRcG1uNkI2dmFGM1BPTkRjUjlES1F2WmtNYmpWTFprK3JZd2VEVjIyNzltWmU4NkNMUnhPcnd3UExGTUVxK050Nlp6TXNlSnFXY0VpVy9YVDhVRGwzZzZoK2hNa3lxWmZwSW1WMnN2RTF6QjhNVE9Ta2liQjhySERLT1BLblVuRUkyUXNlRXBxNnBaOExGU0w4aG5FeUpEYzZC&rh=ff00e0ea621fa0fa3a7c186e1e409606c519609f>) which prohibit NIH from taking any steps to implement, apply, or enforce the NOT-OD-25-068 until further order is issued by the Court.

The office Research and Economic Development now provides the following updated NIH proposal submission guidance:

NIH Proposal Submissions - UPDATE

For NIH proposal submissions, principal investigators are advised to utilize the IDC rates currently approved in UCR's Federally Negotiated Indirect Cost Rate Agreement (NICRA) dated April 9, 2024, until further notice.  Contrary to yesterday's guidance, please NOT include the disclaimer language addressing NOT-OD-25-068 in the Budget Justification.
