Research Security Updates: Foreign Talent Programs

Pursuant to the Chips & Science Act of 2022 ("CHIPS Act") (Section 10631), federal research agencies are in the process of implementing new policies prohibiting the participation in a Malign Foreign Talent Recruitment Program (MFTRP) by Covered Individuals involved with research and development awards from federal research agencies.

To ensure compliance with these new policies, UC has updated its C&G Manual to include definitions of Foreign Talent Programs and "Malign" Foreign Talent Recruitment Programs (MFTRPs) (Section 2-553<https://www.ucop.edu/research-policy-analysis-coordination/resources-tools/contract-and-grant-manual/chapter2/chapter-2-500.html#ch2-553>), and have provided the following resources for review.


  *   UCOP bulletin<https://www.ucop.edu/ethics-compliance-audit-services/_files/compliance/education/compliance-alerts/compliance-alert-31.pdf> discussing changes to APM-025 and APM-671 on July 1st.

     *   Application to or participation in any FTRP is a Category I activity.

Researchers are advised that, in addition to pre-existing required reporting of participation in Foreign Talent Recruiting Programs on biosketches and current and pending/other support forms, researchers applying for or working on a federal award must now disclose if they are a participant of a Malign Foreign Talent Recruitment Program (MFTRP) prior to submission of a federal proposal and within 30 days of becoming a member of a foreign talent recruitment program, malign or otherwise, and annually thereafter.
