Hello,

Good morning..! I hope you are doing well. I am Milan Maji (J1 scholar), a
postdoctoral research associate and an international scholar at UC
Riverside. I need help to change the visa status of my wife from J2 to J1.
She is about to get a postdoctoral offer from Texas A&M University. So she
will have a J1 sponsor from TAMU. She entered the US on *31st Oct 2022* and
her visa is *subjected to section 212E (Ind)*. Can you help me with the
following queries?

1. Is it possible to change the status from J2 to J1 *within the US in this
particular case?*
2. If not, then does she need to *go back to India within 6* months from
the arrival in the US?
3. After returning to India She can book an appointment which takes at
least 60 days wait time in the current situation, so when she gets the J1
visa stamped, it is already *more than 6 months* from the day she actually
visited the US. Is it allowed?
4. If she returns back to India within 6 months of arrival in the US does
she require the to apply for *J2 waiver* (bypass for two year of home
country residency)? Also if it is beyond 6 months what will be the
requirement?

It is my humble request to you to clarify the above confusions from my side
so that I can make the right decision. It is very urgent for me as at the
end of April, she will be completing her 6 months of stay in the US. Please
also let me know whom to mail/ any documents to get a right information.

Thank you very much for your time and kind help.

Best regards,
Milan Maji
