eRA Commons. The Director of NIH has directed NIH staff to review all
existing grants and cooperative agreements to ensure that NIH awards do not
fund off-mission activities or projects. Therefore, temporarily disabling
the NCE functionality in eRA Commons will allow NIH staff to review and
assess all NCE requests to confirm that the activities proposed during the
extension align with the NIH mission and agency priorities.

*NSF IDC Rate Cap: Updated Guidance*


The U.S. National Science Foundation (NSF) issued a *Policy Notice
<https://www.nsf.gov/policies/document/indirect-cost-rate>* on May 3rd
announcing the implementation of an indirect cost rate cap of 15% MTDC for
all new grants and cooperative agreements made to IHEs on or after May 5.


In light of the policy notice, UCOP has issued the following guidance:

*New proposals* submitted on or after May 5th should include the current
negotiated IDC rate but, in order to minimize the chance that NSF will
reject the proposal on that basis, include the following disclaimer
language in proposal submissions:

*“We are aware of the May 2, 2025, National Science Foundation Policy
Notice: Implementation of Standard 15% Indirect Cost Rate. We will honor
the rate identified in this guidance if imposed, but we reserve the right
to re-implement the negotiated rate in the event that this guidance is
rescinded, modified, held unlawful, or otherwise not applicable to this
grant application.” *



Also, it is our understanding that *continuing drawdowns* should be made at
the negotiated rate, without the need to add any qualifying language, based
upon the following statements in the Implementation section of the notice:

   - The 15% rate maximum applies *only to new awards made to IHEs on or
   after May 5, 2025*.
   - This policy does not apply retroactively to existing awards.
   - Institutions are *not required to amend budgets* for awards issued
   before this effective date, nor will they be required to return previously
   reimbursed indirect costs.
   - *Award supplements* that are effectuated via amendments to awards in
   existence prior to May 5, 2025, are not subject to this policy.
   - *Continuing grant increments* are awarded under the original award
   terms and conditions; continuing grant awards in existence prior to May 5,
   2025, are not subject to this policy.

To the extent practicable, you may want to wait to submit proposals given
the possibility of court action limiting the applicability of the new
policy. (Note: A lawsuit has been filed, in which The Regents of the
University of California is one of the plaintiffs, seeking a permanent
injunction to prevent NSF from implementing, instituting, maintaining, or
giving effect to the Rate Cap Policy in any form. Read the filing.
