“Race-Neutral" is the New "Separate but Equal": The Supreme Court, Affirmative Action, and Public Education

This event is a collaboration between UCR SOE's K-12 Ethnic Studies Speaker Series and SOE's Equity and Justice Research Speaker Series



There’s a lot of talk and misinformation about race and college admissions. In the wake of affirmative action’s likely end by the ultra-conservative U.S. Supreme Court, Uma Jayakumar, Associate Professor of higher education, expert witness, and amicus brief author in the legal case SFFA v UNC, explores what’s at stake with the impending Court decision within and beyond education.

Bringing together the ideas of Supreme Court Justice Kentanji Brown Jackson and CRT founder, Cheryl Harris, Jayakumar reflects on past Court cases such as Plessy v Ferguson (1896) that legally formalized  segregation as “separate but equal,” and the significance of affirmative action as tied to the presently emerging anti-“CRT” efforts. As we mourn the end of race-conscious practices into a supposedly “race-neutral” admissions era, it is important that we understand how it relates to the growing movement to censor racial truths and history from educational curriculum and society.

Uma Jayakumar, an Associate Professor in the UCR School of Education, was an expert witness in the SFFA v UNC case, representing the UNC student of color intervenors in the federal district court of North Carolina. When the UNC case was appealed to the Supreme Court last year, Jayakumar became a lead organizer and co-author (with Bill Kidder) of an amicus brief in support of race conscious admissions at UNC, signed by over 1,246 social scientists. Jayakumar has also contributed to multiple amicus briefs submitted to the Supreme Court summarizing key research findings about race-conscious university admission practices, in Fisher I, Fisher II, SFFA v Harvard, SFFA v UNC.
Her scholarship seeking to intervene on higher education structures (race-evasive policies and practices, white normativity and unhealthy campus climates) is featured in numerous amicus briefs, as well as academic venues such as Educational Researcher and the Harvard Educational Review, and supported by Foundations such as Spencer and Ford.

Eddie Comeaux is a professor of higher education, and founding executive director of the Center for Athletes' Rights and Equity (CARE) in the School of Education. He maintains an active research agenda that examines the college student experience—with special attention on athletes and underserved students— and how those experiences influence their subsequent outcomes. Central to much of his work are issues of access and equity. Comeaux has authored numerous peer-reviewed articles in the major journals for higher education and other related fields including Educational Researcher, Journal of Higher Education, Journal of Intercollegiate Sport, Journal of College Student Development, Journal of Student Affairs Research and Practice, and Sociology of Sport Journal.

Rita Kohli is an associate professor of Race, Teaching, and Teacher Education in the School of Education at UC Riverside. About SOE's K-12 Ethnic Studies Speaker Series
Ethnic Studies is the critical, interdisciplinary study of race, ethnicity, and Indigeneity with a focus on the history, experiences, and perspectives of Black, Indigenous, Latina/o/x, Asian American, Pacific Islander and other communities of Color within and beyond the United States. The K-12 Ethnic Studies Pathway at UC Riverside's Teacher Education Program (TEP) exposes students enrolled in the English and Social Studies credential/Master's to the principles of Ethnic Studies, exploring applications to K-12 school pedagogy and curriculum. One goal, among many, is to create a pipeline of educators who are equipped with the knowledge, skills, and experiences to serve as Ethnic Studies teachers across the region, state, and country. To enhance the scholarly and activist nature of the work, SOE's K-12 Ethnic Studies Speaker Series engages the School of Education and the broader community with the voices and work of critical scholars, practitioners, and community activists that enhance understanding of Ethnic Studies. About the Equity & Justice Research Series
SOE's speaker series aims to engage the education research of SOE students and faculty focused on equity and justice, and to also explore what equity and justice work looks like in practice. The series invites researchers to present to students and faculty in an informal setting to encourage dialogue and discussion. SOE is currently taking submissions for presenters. Presenters do not need to present advanced papers but may instead use the interaction with event participants to help refine their ideas and ongoing work.
