Dear GSOE Graduate Students:

Please find the memo below regarding the rescission of temporary amendment to the residency policy.

I reached out to the Residency Coordinator on campus to clarify what this means for domestic students that started Fall 2020 that did not move to California. Essentially, students who were enrolled all last year were considered in-residence and must move to California before 9/20 if they want to avoid paying non-resident tuition ($5,034 per quarter).

RE: Corrected Rescission of Temporary Amendment to Residency Policy and Guidelines

Dear Colleagues:

Consistent with my delegated authority as UC Provost, I am rescinding the temporary amendments issued in October 7, 2020 to the University’s guidelines on establishing residency in the context of systemwide COVID-19 mitigation efforts effective immediately. This letter dated June 15, 2021 includes technical corrections to the June 3, 2021 announced rescission.

The University plans to conduct instruction largely in person for 2021-22. As such, it is important for the University to return to its regular definitions of residency, both for fidelity to its own policies and to reflect the intent of the State of California in providing tuition benefits to its residents. In order to receive in-state status under Regents Policy 3105, a student must demonstrate: (1) physical presence in California for more than one year and (2) intent to make a primary and permanent home in California. (Regents Policy 3105 I.B.1-2.).

This letter rescinds the 2020 temporary amendment and provides guidance to students and campuses on policy implementation for Fall 2021.

RESCINDING TEMPORARY AMENDMENT TO UC RESIDENCY POLICY AND GUIDELINES

The UC Residency Policy and Guidelines (the “Guidelines”) currently provide that students must be physically present within California for a year prior to the Residency Determination Date (RDD) and that absences of six weeks or more in a one-year period disqualify a student from receiving in-state status.

In response to the COVID-19 pandemic, the Guidelines were temporarily amended to allow eligible students entering during the 2020-21 academic year to use remote instruction to stand in for physical presence. Eligible students who studied remotely during 2020-21 may be eligible to qualify for residency in 2021-22 effective with the term in which they physically reside in California. Consistent with the amendment, these students will be asked to provide legal indicia demonstrating their intent to stay in California as soon as is practicable.

Also consistent with the Temporary Amendment, all new students commencing enrollment in 2021-22 will be held to the standards and deadlines in the Guidelines.

All stipulations in the Temporary Amendment issued in October 2020 are rescinded as of the date of this letter.

Campuses may consider providing scholarships or fellowships to offset Nonresident Supplemental Tuition (NRST) to continuing students who remain out-of-state for compelling circumstances related to the pandemic. However, such students will remain nonresidents for reporting purposes to the State and may not be exempted from NRST.
