<p class="MsoNormal">As a result of court decisions in the recent <i>Stanford v. Roche</i> case, the University has amended the Patent Acknowledgment form that is signed by all employees and other personnel who use University research facilities or University
gift, grant or contract research funds. The updated 2011 Patent Acknowledgement form should be used for new employees, appointees and visitors starting
<b>Tuesday, November 1, 2011.<o:p></o:p></b></p>
<p class="MsoNormal"><b><o:p> </o:p></b></p>
<p class="MsoNormal">Because of the court decisions, it is critical that the University now clarify that the intent of the Patent Acknowledgement still is to assign to the University rights to inventions and patents that are made using University resources
and facilities. The clarification will ensure that the University can continue to meet its legal obligations (e.g., to sponsors of research), properly manage its assets and meet its responsibilities as a public trust under the State Constitution. Please
note that the University Patent Policy itself is not changing, and the scope of inventions that are assignable to the University has not changed.
<o:p></o:p></p>

<p class="MsoNormal">The Patent Acknowledgement will be updated in two steps over the next several months:<o:p></o:p></p>

November 1, 2011</b>, all newly hired employees, appointees and visitors will sign the updated 2011 Patent Acknowledgement.

</span></span><![endif]>Patent Amendment for current employees. Beginning November 28, 2011, all faculty, staff and visitors hired on or before October 31, 2011, will be asked to sign the 2011 Amendment to the Patent Acknowledgment or Patent Agreement that
they last signed upon employment of appointment to the University. An outside vendor will manage this process that will enable current employees to electronically sign the Amendment during a three-month period ending February 29, 2012. More information
on this process will be forthcoming over the next few weeks.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">The updated 2011 Patent Acknowledgment is attached (in fillable pdf format). Gabe Nwandu will be sending this email and the form to the PPS User Group to ensure all departments begin using the 2011 Patent Acknowledgement on
<b>Tuesday, November 1, 2011. </b>Only personnel hired on or before October 31<sup>st</sup> will be asked to sign the amendment so departments must take care to make the transition to the new form precisely on November 1<sup>st</sup>.

<p class="MsoNormal">In addition, if a department is sending employment paperwork prior to the effective employment date that occurs on or after November 1, 2011, the employment paperwork must include the 2011 Patent Acknowledgement (not the 1997 version).<o:p></o:p></p>
